Terms of Service

These Terms of Service ("Terms") govern your use of IEP Pulse ("the Service"), operated by Mekoce Walker ("we," "our") based in Washington, DC. By creating an account or using the Service, you agree to these Terms.
1. Eligibility
IEP Pulse is intended for use by licensed educators, related service providers, and authorized school personnel. You must be at least 18 years old to create an account. The Service is not intended for use by students or children.
2. Your Account
You are responsible for maintaining the security of your account credentials. You agree to:
- Use a strong, unique password
- Not share your login credentials with others
- Notify us immediately if you suspect unauthorized access to your account
- Ensure that anyone you share student records with via the Service is authorized to access those records under FERPA
3. Data Ownership
You own your data. All student education records, observations, progress reports, and other content you enter into IEP Pulse remain your property (or the property of your school/district). We do not claim ownership of any user-generated content.
You grant us a limited, non-exclusive license to process your data solely for the purpose of providing the Service — including AI-powered analysis, report generation, and email notifications. This license terminates when you delete your data or account.
4. Acceptable Use
You agree to use IEP Pulse only for its intended educational purpose. You will not:
- Enter student data that you are not authorized to access under FERPA or your school's policies
- Share student records with individuals not authorized to view them
- Use the Service for any commercial purpose unrelated to education
- Attempt to access other users' data or circumvent security controls
- Use the Service to store data unrelated to IEP progress monitoring
- Reverse engineer, decompile, or attempt to extract the source code of the Service
5. FERPA Compliance
We commit to acting as a "school official" under FERPA when processing student education records. Our obligations are described in our Privacy Policy. You are responsible for:
- Ensuring your use of IEP Pulse complies with your school's or district's policies regarding third-party educational tools
- Entering only data you are authorized to access
- Sharing student records within the Service only with authorized personnel
- Covering or redacting visible names, IDs, dates of birth, or other PII in uploaded photos or documents when you do not want that information shared for AI analysis
6. AI-Generated Content
IEP Pulse uses artificial intelligence (Anthropic Claude) to generate progress report narratives, observation analysis, and goal cleanup. You acknowledge that:
- AI-generated content is a tool to assist your professional judgment, not a replacement for it
- You are responsible for reviewing all AI-generated content before using it in official IEP documents
- AI outputs may contain errors and should be verified for accuracy
- Some features may analyze uploaded photos or documents directly, so visible PII in those files should be covered or redacted before upload if you do not want it shared
- We do not guarantee that AI-generated reports meet any specific district or state formatting requirements
7. Subscription and Payment
IEP Pulse offers free and paid subscription tiers. If you subscribe to a paid plan:
- Billing is monthly and processed via Stripe
- You may cancel at any time; cancellation takes effect at the end of the current billing period
- We do not store your payment card information — it is held securely by Stripe
- Refunds are not provided for partial billing periods
8. Service Availability
We strive to keep IEP Pulse available and reliable, but we do not guarantee uninterrupted access. The Service is provided "as is" without warranties of any kind, express or implied. We may experience downtime for maintenance, updates, or circumstances beyond our control.
9. Account Termination
By you:You may delete your account at any time using the in-app "Delete Account" feature. This permanently removes all your data (students, goals, observations, reports, uploaded files, and your account) within our primary database immediately and from backups within 30 days.
By us: We may suspend or terminate your account if you violate these Terms, with notice when possible. If we terminate your account, we will provide a reasonable opportunity to export your data before deletion.
10. Limitation of Liability
To the maximum extent permitted by law, IEP Pulse and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or damages arising from reliance on AI-generated content.
Our total liability for any claim related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
Nothing in these Terms limits liability for data breaches caused by our negligence or willful misconduct.
11. Indemnification
We will indemnify and hold harmless you and your school/district from damages arising from a data breach or FERPA violation caused by our negligence or failure to comply with our obligations under these Terms and our Privacy Policy.
You agree to indemnify us from claims arising from your misuse of the Service or your failure to comply with FERPA or your school's policies regarding student data.
12. Changes to These Terms
We will notify all registered users via email at least 30 days before any material changes to these Terms take effect. If you do not agree with the changes, you may delete your account before they take effect. Continued use after the effective date constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the District of Columbia, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of the District of Columbia.
